Welcome to the Informational Website for the Volkswagen Timing Chain Settlement.

A class action settlement, known as In Re Volkswagen Timing Chain Product Liability Litigation, Civil Action No. 16-2765 (JLL)(JAD) was granted preliminary approval by the Court on June 14, 2018. The Settlement resolves a lawsuit related to the timing chain system in certain Volkswagen and Audi vehicles purchased or leased in the United States and Puerto Rico.

You are included in the Volkswagen Timing Chain Settlement if you are a person or entity who purchased or leased a Settlement Class Vehicle. A Settlement Class Vehicle is defined as certain 2008 through 2014 model year VW and Audi vehicles, as designated by the Vehicle Identification Number (VIN), imported and distributed by Volkswagen Group of America Inc. for sale or lease in the United States or Puerto Rico. The following year and model vehicles, whose VINs are included in the VIN lookup database, have been identified as Settlement Class Vehicles:

If you paid to repair or replace your timing chain and/or timing chain tensioner, and/or if you paid to repair or replace your engine due to a timing chain or timing chain tensioner failure, within certain specified time and mileage parameters, you may be entitled to reimbursement of those costs. Also, you may be eligible for an extension of your vehicle’s New Vehicle Limited Warranty to cover future repairs related to a timing chain or timing chain tensioner failure.


Class Members’ Legal Rights and Options
Submit a Claim Form The only way to receive a cash payment from the Settlement. If you submitted a claim for the earlier settlement, your claim will be processed for the new Settlement, and you do not need to submit another claim. All Claims must be submitted online or postmarked by January 25, 2019.
Exclude Yourself

Important Note: The deadline to exclude yourself from the Settlement has been extended to December 3, 2018 for Settlement Class Members who have Class Vehicles registered in the state of New Hampshire.

Receive no benefits from the Settlement, but keep your rights to start or remain part of any other lawsuit against Volkswagen and Audi. If you wish to exclude yourself from the Settlement, you must submit a request by October 12, 2018.

Submit a written statement to the Court about why you don’t like the Settlement. If you wish to object to the Settlement, you must file by October 12, 2018.

Attend Fairness Hearing

Important Note: The Fairness Hearing has been moved to December 12, 2018 at 11:00 a.m.

Ask to speak in Court about the fairness of the Settlement. The Court will review the Settlement on December 12, 2018. If you would like to attend you must submit your request by October 12, 2018. Please note, for Settlement Class Members who have Class Vehicles registered in the state of New Hampshire, you must submit your request to attend by December 3, 2018.

Do Nothing You will receive no payment from the Settlement and will give up your rights to start or remain part of any lawsuit against Volkswagen and Audi.
